How long do I have to file a personal injury claim in New Mexico?
Generally three years from the date of the injury under Section 37-1-8 of the New Mexico statutes. That is a year longer than the two years Texas allows, which surprises people who assume the two states work the same way. Different claims and different defendants can carry shorter deadlines, so confirm yours rather than counting on the general rule.
Can I still recover if the crash was partly my fault?
In New Mexico, usually yes. New Mexico follows pure comparative negligence, so your recovery is reduced by your share of the fault but is not cut off by it. Texas is different: there, being more than 50 percent at fault bars recovery entirely. If a crash happened near the state line, which state's rule applies can change the outcome completely.
